Paris Hilton filed a lawsuit against Hallmark for using her likeness on a greeting card without her permission. Hallmark’s lawyers recently responded to the suit and totally owned Paris Hilton in the process. TMZ reports:
The company’s motion to dismiss said, “Hilton has become a household name, based in large part on her efforts to draw attention to herself. Having done so, she has subjected herself to public scrutiny and the parodist’s pen. The First Amendment does not allow her to respond by welcoming the fawning and flattering, but silencing the critical and comical.”
In layman’s terms Hallmark basically asked Paris Hilton to accept the fact she’s a press grabbing whore and, also, kindly shut the fuck up. Or something to that effect. It’s been a while since I practiced law. Still a tad rusty, but I think I caught the gist of it.

yeah for #23…paris hilton is a public figure and thus the 1st amendment affords her less protection than a “normal” citizen. paris can’t want attention and then silence critics or stuff that offends her. she of course could still have a defmation claim if they said anything that was untrue.

Hahaha – classic! Deliverance is immortal. =D As for Paris v. Hallmark, it would be incredible if she lost. I hardly know anything about general law, but using her actual face is definitely taking a chance. The card is totally cartoonish in nature though, so who knows? Hallmark might just get away with it. Go Hallmark.
Paris is my favorite actress. She was found on a celebrity and millionaire dating site named (Millionairematch.com/photo/bloger), along with blogs. She did write something about this cooperation recently. I will check it out.

…yeah it does, welcoming is a form of consent, Hallmark peeps, which is neccessary in most legal matters. Look it up.
This shit would’ve blown over much quicker if they’d apologized to her and gave her something. Nothing special, just a book of Sailor Moon stickers or something. She doesn’t have time to hold grudes, she too busy being delicious.
But no, once again corporate jackasses are trying to defend their fuck up instead of just manning up to it. Paris apologized to that one prick who was mad at her, I don’t remember who, no one does, but she did.
