Rihanna photo could get Chris Brown off the hook

Chris Brown’s attorney Mark Geragos is looking to get the alleged beating case dismissed based on the leaked photo of a severely battered Rihanna. E! News reports:

Los Angeles Superior Court Judge Patricia Schnegg today set a preliminary hearing for May 28 on Brown’s double felony case–the result of Geragos pushing for as late a court date as possible to allow him adequate time to respond to the still-pending investigation into just how Rihanna’s police photo was released.
Should the gruesome photos’ appearance prove to be the result of a police transgression, Geragos told E! News that he will move to have Brown’s entire case dismissed.
“The leaks can form the basis for a motion to dismiss the case in regards to outrageous governmental misconduct,” Geragos said.

“Your honor, clearly my client beat the living shit out of his girlfriend, but since the police leaked photograph evidence of said beating to the media, we’re asking you to let him back on the streets with no punishment whatsoever. Then we’re going to sue the cops so he can buy a Lamborghini made entirely out of Toaster Strudels and Faberge eggs.”

    not to ruin this sweet dialogue on racism and whether or not rihanna is fugly, but any other lawyers out there who could explain to me the grounds on which he’s going to get the case dismissed? this has nothing to do with the actual/wrongful collection of evidence, and if it’s a juror-prejudice issue, well, just find some jurors who live under a rock (they’re the only ones stupid enough to make it through voir dire anyway).

    Any evidence that leaves the chain-o-command before the trial, whether by being lost, stolen, or leaked to the media, cannot be used in the trial. Its a safety check in place to insure that the police arent planting evidence, and is often exploited by lawyers. Without properevidence,the judge can be forced to dismiss on a technicality

    There is something seriously wrong with our judicial system.

    There is also something seriously wrong when police officers can and do leak this stuff. Not only should they be fired, but they should be thrown in prison for compromising a case if the outcome of said case is that it is being dismissed due to the leak.

    But if the evidence is there, why does our judicial system ignore it since its been leaked? Fair trial? I am just confused how someone would would not get a fair trial if the photo is leaked, and jurors see the photo, since the photo is already damning and evidence.

    But yeah.. lawyers are awesome. They know their client is a guilty woman beater and they get them off on a technicality, and somehow they sleep at night. It must be in a mattress created from blood money.

    #21 – correct in theory, but not in application. The motion to dismiss in this case would not be based on lack of evidence, but likely on theory that he was so prejudiced by improper release of photo that he will not be able to get a fair trial.

    Presumably, besides that single photo, there are: statements made to police, medical records, witness statements, confessions etc. Likely that there is a wealth of evidence.

    Your discussion of chain of command is correct, I just don’t think that is basis of motion here.

    #29 Shabs (#21) did an excellent job of explaining why – if everything in evidence from autopsy reports to inflammatory photos is leaked, any lawyer with half a brain can argue that it’s not only compromised, but such prosecutorial misconduct means the state’s process is corrupt and it has no intention of playing by the rules. Add that to tainting any jury pool, denying his client’s right to a fair trial. This is the stuff that can get your badge pulled or get you censured or disbarred.

    If the evidence is there, why shouldn’t we see it now, you ask. Because it’s only supposed to be seen in the course of a trial by a jury, not before, and the media can put a spin on it that a courtroom can’t – which is why juries are often sequestered, to keep media and other influences from interfering with the process. The media can fuck up a trial sure as shit and they have far too much weight. (Charles Manson deliberately tried to get a mistrial by showing the jury a newspaper headline where then-President Nixon declared him guilty – when the trial was only half-over.)
    The case is supposed to be tried in court, not the media, and it sucks that someone in the LAPD sold out and compromised it.

    On the other hand, Geragos is a bottom-feeder who’s notorious for claiming shit that never does happen – I think Scott Peterson was supposed to explain it all to us, too. His client list reads like the ‘who’s who’ of scumbags and he hasn’t had a big win in a long time.

    This should be a mistrial – and set a precedent for the media to stay out of a criminal trial. Everyone has convicted him without a fair trial just read some of the comments on this blog. We haven’t heard his statement. This is why we have a jury system, innocent until PROVEN GUILTY.

    No fair trial – then no trial – it is in our constitution.
