Brittany Murphy’s mom gets everything

Brittany Murphy’s apparently executed a will years before she married Simon Monjack which leaves everything to her mother Susan Murphy, according to TMZ:

The house Brittany owned and died in was held in trust — a trust created several years before she met Monjack. He is not listed on the title.
We do not know if Murphy amended her will after she was married. So far we have no evidence Murphy drafted a codicil (amendment) to the will.

Granted, Brittany Murphy had enough money to pay off her husband’s debts at the beginning of their marriage, how much could she honestly be worth right now? She really hasn’t done anything lately and I doubt Brittany made millions doing “Faster Kill Pussycat” with Paul Oakenfold. But if she did, somebody tell a famous DJ I’m awesome at talking over shit, too. Just ask the guy who sat in front of me during Avatar last night. Tell me not to have phone sex read The Nativity Story out loud before Christmas… Why do you hate America?!

    Yo, counselor, help a guy understand your claim.

    If someone’s will says her mom gets 100% and spouse gets zero what will the state law do to change that? Are you saying that spouses are guaranteed a minimum percentage?

    How might this change the arrangement? Will says 100% to mom–none to spouse. 50-50? 75-25?? What if there are kids?

    What good is a will if state laws override?

    That don’t sound right…I am asking you sincerely-not busting balls as usual.

    @#5 – You comments assume that the estate transfers pursuant to a will and probate. Would not the grantor of a revocable trust be able to designate benficiaries without running a foul of statutory resrtictions. Additionally, I am sure that her estate attorney’s contemplated some amount to be paid to the husband…i.e. $100,000 or some other nominal sum. I find it hard ot believe those slick LA ambulance chasers would drop the ball like that.

    Uh, try doing some reasearch before writing a story. While not a fan, I do know that Brittany Murphy continued to be the voice of Luanne on “King of the Hill”, and was earning over $150,000 a voiceover episode. She was making over $3,000,000 a year on that alone; that may not be much to you jaded hollywood types, but that’s a SHITLOAD of money in my book. Her lying con-artist husband didn’t get any of that, and her residuals (which will be worth millions for years to come) will go to her mom as well. Bottom line – her scumbag con-artist husband lost MILLIONS by not being listed in her will. Just shows that crime does NOT pay…

    Good for her. High or not, she took care of her family. Hopefully this will help shut down some of the speculation surrounding her untimely departure. I know for a fact, she was charming, well spoken, and a great voiceover artist. Now I know she was a devoted daughter as well. Sorry for your loss Mother Murphy, you raised a great kid.

    A lot of these medications are also meds used to treat migraines. How about we let go of the speculation and guessing games until the tox screens come back and tell us for sure? I always like Brittany Murphy and I am sad that she’s gone.

    I thought California was a common law state – So unless there’s a prenup, I would think he’s would be entitled to half of her earnings after they were married, in addition to any real property acquired thereafter.

    5 is right…regardless of what is put in trust. A spouse can elect to take their share of an estate from the decedent. This is to prevent the deceased from writing their spouse out of the will. Most states won’t even allow you to say “My spouse can’t take anything from my estate” That clause will be striken unless some type of prenup was signed stating that the surviving spouse takes nothing. Generally, it is about 1/3 of an estate but each state has different levels enabling a spouse to elect from the state.

    @ #44 – Did you get your law degree by filling out the back of a cereal box or Phoenix Online University? A trust instrument will pass the corpus of the trust outside of probate. Am I the only one who has ever established an A/B Trust? How can the probate court strike anything from a trust? You are correct that a spouse can take their share of the estate from the decedent. What happens when there is no estate, dipshit? Let me guess….first year? Probly law review too. Hope whatever firm hires you has rock solid malpractice coverage.
