Bill Cosby Loses In Court, Sexual Assault Case Not Dismissed

Here’s a smiling Bill Cosby – who also waved to fans because he’s just a dear, sweet old grandpa – arriving in court in Montgomery County yesterday where he clearly believes he’s about to get all those sexual assault charges “scuttled” because a former DA allegedly made a backroom deal with his lawyers in 2005. It didn’t work. PEOPLE reports:

Montgomery County Judge Steve O’Neill Wednesday night denied Bill Cosby’s request to dismiss a criminal case against him saying a former prosecutor’s testimony about a promise he made not to prosecute Cosby was not credible.
O’Neill said he based his ruling on “court filings, exhibits and testimony” with the credibility determination of former Montgomery County District Attorney Bruce L. Castor, Jr. being “an inherent part of this court’s ruling.”

Turns out Bruce Castor is a real piece of work who believed he had the “sovereign” power to give immunity to whoever he wanted without a judge’s approval. He did not. However, for what it’s worth, he personally believed Andrea Constand. He just didn’t think she had any “credibility.”

Castor said he decided not to prosecute Cosby because of the many problems with the case: Constand’s delay in reporting; the lack of forensic evidence; her alleged contact with civil attorneys before going to police; her phone contact with Cosby (and possibly one face-to-face meeting) after the alleged incident but before she went to police and discrepancies in her accounts to police.

So basically because Andrea Constand didn’t take precise, exactly perfect steps after being allegedly raped by her mentor, who also happened to be Bill fucking Cosby, her case was already over before it even began. Not to mention, according to reports from the arrest affidavit, Andrea Constand went into emotional isolation before eventually telling her own mother a year later what had happened. From there, her mom called and confronted Cosby who reportedly admitted what he did and started requesting meetings to apologize and make things right/give them shitloads of money to go away. And it’s probably safe to assume that Cosby’s lawyers knew these meetings would damage Andrea Constand’s credibility, which it did because now it looks like some whore trying to deprive dear, sweet Dr. Cosby of his hard-earned money, and that, folks, is fucking rape culture. You can scream all you want that it doesn’t exist and women can just accuse guys of rape and it’s all over for them, but not even close. You literally could rape a woman, and the chances of you being successfully prosecuted are slim to none unless you did it right in front of a jury and she pulls a rape kit out of her butt on the spot. And even then, what was she wearing? Is she behind on bills? Did someone forget to initial the jizz cup? I dunno…
